1. General provisions
Users browsing in this area access the web platform of the company, Fashion Point S.r.l.: http://www.b-exit.com. Browsing, and the transmission of a purchase order on the site, constitutes acceptance of the Conditionsof Sale and of the Data Protection Policy adopted by the site itself therein.
These Conditions of Sale apply to the sale of products and the supply of a service, with the sole reference to purchases made on the www.b-exit.com website, in compliance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree . n. 206/05 amended by Legislative Decree n. 21/14 and Legislative Decree n. 70/03), on behalf of:

Before accessing the products and services provided by the website, the user must read these Terms and Conditions of Sale, which are intended as generally and unequivocally accepted at the time of purchase.
The user is invited to download and print a copy of these General Terms and Conditions of Sale, which Fashion Point S.r.l. reserves the right to modify unilaterally and without notice.
The site and, therefore, the products and services provided by the site, along with your purchases, can be used in the following languages: Italian, English, German, French, and Spanish.
These Conditions of Sale govern the offer, transmission, and acceptance of purchase orders for products and services on www.b-exit.com and do not govern, however, the supply of services or sale of products by other parties, other than the seller, that are present on the same site through links, banners or other hypertext links.
Before sending orders and purchasing products and services from different parties, we suggest that you verify the conditions of sale.
3. Conclusion of the contract
To conclude the purchasing contract, you will need to complete the online process and transmit it following the relevant instructions.
This contains the reference to the General Conditions of Sale, the information about each service purchased, the images of each product and its price, the payment methods that can be used, the method of delivery of the products purchased and the relevant costs for shipping and delivery where provided, as well as a reference to the conditions for exercising your right to withdraw and methods and times for returning the products purchased. The seller is not responsible for any eventual inadequacy of the graphic representations of the products shown if they are due to technical reasons, since the representations are merely for illustrative purposes.
Before concluding the contract, you will be asked to confirm that you have read the Terms and Conditions of Sale, including the Information on the right to withdraw and the processing of personal data.
The contract is concluded when the seller receives the order form, after verifying that the information contained therein is correct.
The purchaser will be obligated to pay the price when the online order transmission process is concluded. This will occur by clicking on the “Complete purchase at the end of the wizard” button. Discount Coupons (or promotional codes) are not transferable or convertible into cash and can not be resold. Unless otherwise specified in the conditions relating to each promotion, the Discount Vouchers (or promotional codes) can not be combined.
Once the contract is concluded, the seller takes charge of the order to execute it.
4. Registered users
In completing the registration process, the user commits to following the instructions on the website and provide his/her personal data, accurately and truthfully.
The confirmation will, however, exempt Fashion Point S.r.l. from any responsibility regarding the information provided. Users undertake to promptly notify Fashion Point S.r.l. of any change in their data whenever they are communicated.
If a user provides inaccurate or incomplete data, or if a dispute arises on the part of the interested parties regarding the payments made, Fashion Point S.r.l. has the right not to activate or to suspend the service until any relevant deficiencies or problems have been settled.
When a user first requests the activation of a profile, Fashion Point S.r.l. will attribute to the same user a user name and password. The user recognizes that such identification constitutes the method for validating access to the services and the only method that is suitable for identifying the user and that the acts performed through such access will be granted to him/her, and shall be binding.
The user undertakes to maintain the secrecy of his/her access to data and guard it with due care and diligence, without giving it, even temporarily, to third parties.
5. Product availability
The availability of the products refers to the actual availability at the time the purchaser places the order. This availability must still be considered purely indicative only because, due to the simultaneous presence of multiple users on the website, the products could be sold to other customers before your order is confirmed.
Even after the e-mail confirmation of the order is sent, the products may still be partially or totally unavailable.. If this occurs, the order will be automatically adjusted, with the elimination of the unavailable product, and the customer will be notified immediately via e-mail.
If the purchaser requests the cancellation of the order, therefore, terminating the contract, Fashion Point S.r.l. will refund the amount paid within 30 days from when Fashion Point S.r.l. has knowledge of the decision of the purchaser to terminate the contract.
Orders will be processed during the following hours: Monday to Friday, from: 9:00am to 1:30pm, 2:30pm to 6:00pm.

7. Payment methods, prices
The price is the one indicated each time on the site, except where there is an obvious error.
If an error occurs, Fashion Point S.r.l. will notify the purchaser as soon as possible, allowing for him/her to confirm the order with the right amount or else cancel it. However, Fashion Point S.r.l. is not obligated to provide what is sold at the price that was mistakenly indicated as lower.
The prices on the site include VAT. Prices are subject to change at any time. The changes will not affect orders for which a confirmation has already been sent.
After selecting the product, it will be added to the cart. Just simply follow the purchasing instructions, and insert or verify the required information at each step of the process. The details of the order may be modified before payment.
Payment can be made through: Paypal, Braintree, Bank transfer, Credit card (Mastercard, Visa, Visa Electron), and Cash on Delivery.
Payments made online through Credit Card, Paypal, and Braintree are protected by a very effective data encryption system and, under no circumstances, will b-exit.com come into possession of the credit card data.
b-exit.com will refund using the same means of payment chosen by the purchaser during purchase. In the event payment is made by bank transfer, it is essential that, in the reason for payment, the references for the invoice and the order are indicated. These will be provided in advance to the customer by email.
If not otherwise specified by the purchaser, when the order is being concluded, the invoice will be sent together with the products purchased.
9. Delivery and shipping costs
Fashion Point S.r.l. ships worldwide.
Delivery, unless otherwise indicated, will take place within a maximum period of three days from the date the order is confirmed (for Italy).
For each order delivered, the customer must specify at least one telephone number, in order to allow for the courier to contact the customer in the event there is difficulty with the delivery.
If the delivery cannot be made, the order will be sent to the courier depot. If this occurs, a notice will be left indicating the place where the products ordered can be found and how a new attempt in delivery will be made.
If the customer is not able to be present at the place of delivery at the agreed time, we ask that the customer contact us again to decide on a new delivery date.
If delivery cannot take place for reasons beyond our control after 15 days from the date on which the order is available for delivery, we will assume that the customer intends to terminate the contract.
If the contract is terminated, the sum for the products will be returned, and the customer will be charged for the cost of storage or return to sender, as quantified by the courier, or the products can be picked up from the courier’s handling center. In any case, the termination of the contract will take place within 30 days from receipt of the order.
If provided for by the products and the relevant area, the shipping costs are charged to the purchaser and are explicitly specified at the time of the order.
Shipping costs are free for purchases over €99.00.
Upon delivery of the products, the customer is required to check:
that the number of packages delivered is the same as indicated in the transport document;
that the packaging is intact and not altered, even with regard to the packing tape.
In the event the package has been tampered with and/or is broken, the customer must immediately challenge the shipment and/or delivery by adding the words “Goods Subjected to Verification”" on the copy of the delivery document to be returned signed to the carrier or other operator.
The customer is required to report any damage within 3 (three) days of receipt of the products, by registered mail with receipt of notice, in advance by fax or by e-mail at the following addresses: firstname.lastname@example.org
10. Transfer of risk
The risks related to the products will pass to the purchaser from the time of delivery. The proprietorship of the products is considered acquired once full payment of all amounts due is received in respect thereof, including any delivery charges, or upon delivery if this occurs at a later time.
11. Warranty and trade compliance
The seller is liable for any defects of the products offered on the site, including products ordered that do not conform with those on the site, pursuant to the provisions of Italian law.
If the purchaser has entered into a contract as a consumer - that is to say any individual acting on the site for purposes unrelated to business or professional activities - this warranty is valid on the condition that: the defect appears within 24 months from the date of delivery of the products; the buying party formally claims the defects within a maximum of 14 days from the date on which the defect has been recognized by the latter; the online return form is correctly completed: https://www.b-exit.com/request-of-return.
In the event of non-compliance, the purchaser who entered into the contract as a consumer is entitled to obtain a correction of the non-conformity of the products free of charge, through repair or replacement, or to obtain an appropriate price reduction or the termination of the contract with respect to those specific products, and a consequent refund.
All Return shipping costs for defective products are the seller’s responsibility.
12. Right to Withdraw
In accordance with the legal provisions in force, the purchaser is entitled to cancel a purchase without penalty and without any reason, within 14 days, pursuant to Section 57 of Legislative Decree 206/2005 from the date the products are received.
In the event of multiple purchases made by the purchaser with one order and delivered separately, the 14-day period starts from the date the last product was received.
The buyer who wishes to exercise the right to withdraw must notify Fashion Point S.r.l. through an explicit statement, which can be sent by registered mail with receipt of notice, in advance by fax or by e-mail at the following addresses: email@example.com
The purchaser is obligated to return, at his/her expense and transportation risk, the products that he/she intends to return. The right to withdraw does not apply in the event of products made to specifications or that have clearly been personalized or, because of their nature, cannot be returned or risk deterioration or rapid expiration.

The products must be returned intact in their original packaging, complete in all their parts and with the relevant tax documents attached. Notwithstanding the right to verify compliance with the above, the website will refund the amount of the products covered by the right to withdraw within a maximum period of 30 days.
As provided for by Section 56, paragraph 3 of Legislative Decree 206/2005, and as amended by Legislative Decree 21/2014, the website can suspend the refund until the products are received or until the purchaser proves that the products were sent back to the seller.
The site will refund the purchaser using the same payment method chosen during purchase. In the event of a bank transfer or cash, and if the purchaser intends to exercise his/her right to withdraw, the bank information must be provided: IBAN, SWIFT, and BIC are required for the refund.
13. Personal Data Processing
By utilizing the website, the user consents to the processing of personal data. The data controller is Fashion Point S.r.l. The data processor is Dr. Michele Ciaccia.
The data are processed exclusively in electronic form, through IT tools and supports that ensure security and confidentiality of the same data.
The stored information is protected against unauthorized access.
The data provided for by the user are processed in relation to: purchase orders, payments (which may include name, address, contact information), IP address, and all other data provided.
The data is used for the purpose of executing the purchase and for payments, as well as communicating data to third party suppliers of payment services, shipping, contacts of an informational nature regarding the activities and services of the site, and also commercial offers of affiliated companies and business partners.
IProviding data and allowing it to be processed for the purposes set forth in the contract, or for fulfilling the order and its payment, is necessary to conclude, as well as execute the contract. Therefore, if the user refuses to provide such data, or to provide consent for them to be processed, the user will not be able to buy the products and services offered.
Providing data and allowing it to be processed for the purpose of sales communications is optional. However, a refusal to provide such data or to process them, may result in the inability for the user to receive these additional services.
The user always has the right for his/her data to be updated, corrected or integrated, as well as to have them cancelled, anonymized or blocked if they are processed in violation of the law, including those which need not be kept for the purposes for which the data were collected or subsequently processed, the confirmation that the procedures have been made known, also with regard to their content, to those to whom the data were communicated or distributed, except when this fulfillment proves to be impossible or involves the use of methods manifestly disproportionate to the protected right.
For legitimate reasons, the user has the right to object, in whole or in part, to having the data that are personally related to him/her processed, even if pertinent to the purpose of the collection and processing of personal data aimed at sending advertising or direct sales material or for carrying out market research or sales communications.
At any time, the user may revoke the consent to processing data previously granted to Fashion Point S.r.l.

On the first visit to the site, the user will be asked to select a language and will be given the option of saving the language preference. To this end, the user authorizes the use of identification codes, cookies, i.e. small files sent from his/her internet server and that are stored on the hard drive of the computer.
The hard drive contains information on the preference related to the user’s language and stores the web pages visited by the user. Cookies are used to prevent the user from receiving the same information repeatedly or in the wrong language and to adapt the content and presentation of the site to the type of browser utilized by the user.
14. Safeguarding clause
In the event that one of the clauses of these Conditions of Sale is void for any reason whatsoever, this will not, in any way, compromise the validity and compliance with the other provisions contained in these Conditions of Sale.

16. Governing Law and Jurisdiction
These Conditions of Sale are governed by Italian law and interpreted according to it, except for any other different mandatory provision of the country where the purchaser usually resides. Therefore, the interpretation, execution, and resolution of the General Conditions of Sale are exclusively subjected to Italian law, and any disputes related and/or consequential to the same will be exclusively resolved by Italian judicial authorities. In the event of a dispute, the place of jurisdiction is Pescara.
